Chicago Same-Sex Divorce Attorneys
Providing Compassionate and Knowledgeable Legal Guidance
Many of the challenges same-sex couples face during the divorce process are not unlike what other couples encounter. Both types of divorces involve financial and emotional challenges, issues pertaining to child custody and the division of property. However, this is still a relatively new practice area and, as such, new legal obstacles still arise.
At the Law Offices of Jonathan Merel, P.C., our Chicago same-sex divorce lawyers are prepared to assist you so you can achieve a swift and favorable resolution.
Contact the Law Offices of Jonathan Merel, P.C. in Chicago today at (312) 487-2795 to discuss the details of your same-sex divorce during a free 20-minute consultation with a member of our legal team.
Filing for a Divorce in Illinois
In Illinois, same-sex couples file for divorce like anyone else. Since Illinois is a no-fault state, the spouse who files a Petition for Dissolution of Marriage does not have to list anything beyond irreconcilable differences as a reason for divorce. You must also file for divorce in the county where you reside, assuming you meet the 90-residency requirement for the state.
The Unique Challenges of a Same-Sex Divorce
Generally, the divorce process for same-sex couples is not different compared to a divorce involving a heterosexual couple. That said, child custody in such cases can still present some obstacles. For example, if you were not the biological parent of the child and never went through the legal process of adopting the child, the court might be hesitant to award you with visitation or custody rights. In such cases, the court would not order that parent to pay child support.
Additionally, same-sex couples often face issues during the process of property division. Many same-sex couples lived in a marriage-like arrangement long before it was legal, commingling assets and property throughout the years. Unfortunately, since same-sex marriage has only been legal since 2014, it can complicate matters, making the division of assets and debt an immensely contentious issue. Moreover, the outcome of asset division can have a profound impact on spousal support.
